O ring on 23 horse Kaw not part of the engine?

For you fellas that service engines.

If an o-ring is damaged at the drain spickitt, is it possible that Kaw would not consider this a warrenty item on the engine? Mine has had 2 such leaks at the spickett, and the dealer fixed the first one no cost, but the second one charged for parts and said it is not part of the engine. Is it possible that he is speaking the truth, or is he a lying bastage as I assume?

I am not the cause of this damage, I made it clear that the drain pipe never moved, and could not have been damaged by my negligence, and he still insisted I pay for the parts. Not a big financial deal to me, just an irritant.
