Even if the govt wanted to do it, the ones he defrauded will not want to testify. It would make them look even more stupid. Since its private money they won't get anywhere without co-operating witnesses. Only chance is if this roils some bank then things might change.

So it will be all rolled up in the end. Best case is the fraudster makes some minimal deal with .gov and does some short time or pays some small fine.
