Yes that is what Ascent did but the formal procedure is that you are to ensure the filter to be tested cannot bypass and that the bubble test is on the test element.

My two XG2's leaked oil through the gap at roughly the same rate so you wouldn't know. The ISO test requires a filter to be not leaking before testing which requires the manufacturer to provide the differential pressure spec.

This is a bigger scandal than Purolator tears because you may or may not have ended up with a torn filter and if you did, you probably didn't have bypass for the entire fci. With these, you are almost guaranteed a bypass and you'll have it for the entire service life of the filter.
